This is an annual publication. The 2010 edition was released January 2010.

Description:

The Employment Standards Act, 2000 (ESA, 2000) sets out the rights and responsibilities of employees and employers in Ontario workplaces. The standards outlined in the ESA, 2000 represent the minimum standards that employers must provide to their employees.

The Ontario Employment Standards Act: Quick Reference, 2010 Edition focuses on the key obligations for employers under this broad piece of legislation. If your responsibilities include hiring of employees or managing and supervising, or payroll, or any duty that requires you to make decisions regarding employment policies, you can be at legal risk if you don't adhere to the Employment Standards Act, 2000. Save money, time and reduce your risk.

New to this edition:
  • The introduction of special rules relating to temporary help agencies, their employees (now called "assignment employees") and their client businesses, including the removal of barriers to securing permanent employment, and the addition of entitlements like public holiday pay, termination pay, and severance pay.
  • The introduction of a new type of unpaid, job-protected leave called organ donor leave. Those employees wishing to donate certain organs may take up to 13 weeks off (or up to 26 weeks off, if deemed medically necessary) in order to do so.
  • The removal of certain exemptions that once applied to elect to work employees (including exemptions from public holiday pay, termination pay, and severance pay).
  • An amended section on temporary lay-offs. This section is especially important in times of economic crisis, where employers are looking for ways to temporarily reduce personnel costs, but the common law may pose obstacles.
  • Commentary regarding new protections for live-in caregivers (nannies).
  • A new section on call-in pay and minimum wage.
This Quick Reference volume also contains the full text of the Employment Standards Act, 2000.
